W imieniu organizacji UIA, zachęcamy do udziału w webinarze pt. “Obszary alternatywnego rozwiązywania sporów: sądy, arbitraż, mediacja; czynniki wyboru”. Podczas spotkania paneliści przedstawią Deklarację w sprawie zapobiegania sporom i ich rozwiązywania oraz roli zawodów prawniczych (ang. Declaration on Dispute Prevention and Resolution and the Role of the Legal Profession) oraz zainicjują dyskusję z przedstawicielami samorządów adwokackich na temat tego, w jaki sposób izby adwokackie mogą wspierać procesy zapobiegania i rozwiązywania sporów oraz wdrażać Deklarację w swoich jurysdykcjach.

Deklaracja w sprawie zapobiegania sporom i ich rozwiązywania oraz roli zawodów prawniczych: Dispute Prevention and Resolution Declaration (DPR)

Dear collective members of the UIA,

We are pleased to inform you that on 29 October 2025 the General Assembly at its annual meeting during the UIA Congress in Guadalajara (Mexico) approved the Declaration on Dispute Prevention and Resolution and the Role of the Legal Profession.

The Declaration:

  • Recognises the importance of Dispute Prevention and Resolution (DPR) methods offering to the parties to disputes, conflicts, and litigation the opportunity for resolving them by means of negotiation, mediation or conciliation.
  • Underlines a new role of the legal profession as conflict preventers and resolvers, not only in respect of disputes involving their clients, but also in respect of the wider conflicts emerging within society, exacerbated by social media, where it is increasingly difficult to get people to have conversations and listen to one another.
  • Hence the need to rebuild the communication link and the trust between the parties, to encourage the parties to resolve matters consensually and to communicate peacefully and respectfully in a dedicated space by means of an open and constructive dialogue (that can be facilitated by a third independent, impartial, and neutral person) and if they choose to settle, to reach a mutually satisfactory outcome more effectively than by going to court.
  • Encourage lawyers to adapt their offer for legal services to include consensus-based dispute prevention and resolution methods, and to develop their professional skills and practice; lawyers in turn should encourage their clients to understand that „their day in court” is not the only option, and that the recourse to the civil and commercial courts should be used in a responsible way, in situations when dialogue and collaboration cannot and will not be successful.
  • Thus encourage all lawyers to change their mindset, and to promote this change among arbitrators, judges and in-house counsels.

More specifically the UIA, recognising the key role of Bars in supporting the legal profession in this evolution at the global level, calls upon all Bar Associations and Law Societies:

  • To promote the legal profession’s consideration of DPR methods.
  • To this end, when the applicable law does not impose a legal obligation, to recommend that lawyers as part of their professional duties under their rules of conduct, to explore the possibility of preventing and resolving conflicts through direct negotiation or mediation or any other means of anticipation or appropriate resolution, and to examine with their clients the possibility of preventing and resolving their problems, disputes, conflicts and litigation by resorting to DPR methods prior to commencing proceedings or whilst court proceedings are pending or when drafting a legal document by introducing a clause to this effect.
  • To also encourage lawyers to prepare clients for a mediation meeting and to assist clients in mediation, enhancing the role of lawyers in respect of mediation as an effective DPR method.
  • To promote the implementation of specific training programmes and the UIA’s offers in this respect.
  • To promote a viable business model; to work on enhancing the service provided by lawyers to their client by implementing DPR methods.

We ask you to proactively support the Declaration and its objectives and to circulate it among your members.

For this purpose, we invite your representatives to attend a webinar with round table of experts scheduled on 4 February 2026 at 4:00 pm CET on the topic of “Alternative Dispute Resolution Arenas: The Courts, Arbitration, Mediation; Factors in Selection” during which the panellists will make a presentation of the Declaration and open the discussion with Bar representatives on how Bars can support DPR processes and implement the Declaration it in your jurisdiction.
